Good To Go Rentals, LLC — Terms & Conditions

These Terms and Conditions ("Terms") govern your rental of reusable plastic moving totes and related equipment ("Rental Items") from Good To Go Rentals, LLC ("Company," "we," "us," or "our") through goodtogorentals.com or otherwise. By placing an order, signing a rental agreement, or accepting delivery of any Rental Items, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree, do not place an order or accept delivery.
1. Eligibility and Account Accuracy
You must be at least 18 years old and legally capable of entering a binding contract to rent from us. You agree to provide accurate, current, and complete information when placing an order, including a valid delivery address and payment method.
2. Reservations, Orders, and Payment
- Orders are confirmed upon receipt of payment (or deposit, if applicable) and our confirmation notice.
- Rental fees, delivery fees, and any applicable deposit are due as stated at checkout.
- We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud, non-payment, or unavailability of inventory, with a refund of amounts paid for the cancelled order.
- Prices are subject to change without notice for future orders; the price at the time your order is confirmed applies to that order.
3. Rental Period, Delivery, and Pickup
- The rental period begins on the scheduled delivery/start date and ends on the scheduled pickup/return date stated in your order, unless extended in writing.
- Customer is responsible for having Rental Items available and accessible at the agreed pickup location and time at the end of the rental period.
- All delivery and pickup of Rental Items is performed exclusively by Company. Company does not offer a self-service, drop-off, or independent return option.
- Late returns may incur additional daily rental charges at our then-current rate. Rental Items not returned within 24–48 hours of the scheduled return date, without prior communication, may be treated as lost and Customer will be charged the full replacement cost in Section 6.
- Automatic Extension: If any Rental Item is not returned by the agreed return date, the rental automatically extends on a day-to-day basis at $2.00 per Rental Item per day (the "Auto-Extension Fee") until the item is returned or deemed lost.
- Company-Arranged Pickup: For overdue Rental Items, Company will arrange pickup and Customer will be charged $1.99 per mile round-trip from Company's place of business, with a minimum $50.00 per pickup, plus tolls. This is in addition to the Auto-Extension Fee.
- Company is not responsible for delays due to circumstances outside our reasonable control (Section 13).
4. Use of Rental Items
- Rental Items are provided for ordinary residential or commercial moving and storage purposes only.
- Customer agrees not to overload, alter, modify, sublease, or use Rental Items for any illegal purpose.
- Customer is responsible for the Rental Items from delivery until return and acceptance by Company, including loss, theft, or damage (ordinary wear and tear excepted).
- No adhesive tape: Rental Items are designed to close via snap-lock lids and zip ties through built-in loops. Applying packing tape, duct tape, or other adhesives leaves residue that permanently marks the plastic and is treated as damage under Section 6.
5. Inspection and Condition
Customer should inspect Rental Items at delivery and notify Company within 24 hours of any pre-existing damage or defect. Absent such notice, Rental Items are deemed to have been delivered in good, usable condition.
6. Damage, Loss, and Fees
- Customer is responsible for repair or replacement cost of any lost, stolen, or damaged Rental Item beyond ordinary wear and tear, up to full replacement value.
- Totes returned soiled or contaminated may incur a minimum $10 cleaning fee per tote.
- Any deposit collected may be applied toward late fees, damage, loss, or cleaning charges.
- Company may charge the payment method on file for any fees due under this Section without further authorization.
7. Cancellations and Refunds
- Within 24 hours of order: 100% refund.
- After 24 hours: A $10 cancellation fee applies to cover credit card processing costs; the balance is refunded.
- Within 48 hours of delivery: Non-refundable, as delivery logistics are already in place.
8. Assumption of Risk
Customer acknowledges that the use, loading, transport, stacking, and handling of totes and moving equipment involves inherent risks, including strain, injury, property damage, and damage to contents. Customer voluntarily assumes all such risks.
9. Disclaimer of Warranties
The Rental Items and Services are provided "as is" and "as available." To the fullest extent permitted by applicable law, Company disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability; Release
To the fullest extent permitted by applicable law, Company's total aggregate liability arising out of or related to the Rental Items or Services shall not exceed the total rental fees actually paid by Customer for the specific order. In no event shall Company be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of use or damage to belongings placed within Rental Items.
Nothing in these Terms limits liability that cannot lawfully be limited under New Jersey or Pennsylvania law, including under the New Jersey Consumer Fraud Act or Pennsylvania's Unfair Trade Practices and Consumer Protection Law.
11. Indemnification
Customer agrees to indemnify, defend, and hold harmless Company and its owners, members, employees, and agents from third-party claims arising out of Customer's use or misuse of the Rental Items, violation of these Terms, or violation of applicable law.
12. Insurance
Company does not provide insurance covering Customer's belongings. Customer is solely responsible for obtaining appropriate insurance for items being moved or stored.
13. Force Majeure
Company shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, weather, natural disaster, fire, labor disputes, government action, pandemic, or supply chain disruption.
14. Termination
Company may suspend or terminate Customer's order or access to the Services at any time for violation of these Terms, non-payment, or misuse of Rental Items.
15. Governing Law and Venue
These Terms shall be governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. If your order originates from or is delivered within Pennsylvania, applicable Pennsylvania consumer protection law will apply to the extent required. Any dispute shall be brought exclusively in the state or federal courts located in New Jersey.
16. Dispute Resolution
Before filing any claim, Customer agrees to first contact Company at info@goodtogorentals.com to attempt informal resolution. If the dispute cannot be resolved within 30 days, either party may pursue available remedies under Section 15.
17. Severability
If any provision is held invalid or unenforceable, that provision shall be limited to the minimum extent necessary and the remaining provisions shall continue in full force.
18. No Waiver
Company's failure to enforce any provision shall not be construed as a waiver of that or any other provision.
19. Entire Agreement
These Terms, together with any order confirmation or fee schedule, constitute the entire agreement between Customer and Company regarding the Rental Items and Services.
20. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time you place an order will govern that order.
